Enot Terms of Service

By registering for an API key, uploading audio, or otherwise using Enot, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.
These Terms are intended to allocate risk clearly. They are not a substitute for advice from your own lawyer.
1. The service
Enot transcribes and structures voice / meeting media you send to our API and returns Markdown for your Obsidian vault (via the official plugin or compatible clients). Features may include speaker hints, glossaries, action items, and agreement sidecars. Output quality depends on audio quality, models, and third-party APIs and is not guaranteed.
We may change, suspend, or discontinue features with reasonable notice when practicable.
2. Accounts and API keys
You must keep your API key confidential. You are responsible for activity under your key. We may revoke keys for abuse, non-payment, legal risk, or security incidents.
Registration records acceptance of these Terms and the Privacy Policy (tos_accepted_at on new accounts).
3. Your content and warranties
You retain rights in content you upload. You grant us a limited license to process that content solely to provide the service (transcribe, analyze, deliver notes, meter usage, secure the platform).
You represent and warrant that:
- you have all rights and consents needed to record and upload the audio (including from other participants where required by law);
- your uploads do not violate law, others' privacy, confidentiality duties, or intellectual-property rights;
- you will not upload illegal content (including child sexual abuse material), malware, or content intended to harass or defraud.
You are solely responsible for how you use transcripts and notes (including decisions made from them).
4. Prohibited use
You may not: reverse-engineer the service except as allowed by law; overload or attack the API; bypass quotas or paywalls; resell raw API access without our written consent; or use Enot to build competing datasets by systematically scraping outputs we generate for you beyond normal personal/team use.
5. Billing (Whop)
Paid plans and checkout are handled by Whop under Whop's terms. Fees, taxes, renewals, and refunds follow Whop's rules and the plan description shown at checkout. Trial and hour limits are described in the plugin / /v1/me. Deleting your Enot account does not cancel Whop memberships automatically. Cancel in Whop if needed.
6. Third-party processors
Speech and note generation may use Contabo hosting, optional GPU workers (e.g. Vast), OpenRouter models, and Whop. Their availability and policies affect the service. We are not liable for outages or acts of those providers beyond what mandatory law requires.
7. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENOT IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that transcripts/LLM summaries are complete or correct.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or business opportunity;
- our total liability arising out of or related to Enot in any 12-month period is limited to the greater of (a) the fees you paid us for Enot cloud processing in that period via Whop, or (b) EUR 50 if you only used a free trial / unpaid access.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (including for death/personal injury caused by negligence, fraud, or willful misconduct, where such rules apply).
9. Indemnity
You will defend and indemnify Danila Nekrasov / Enot against claims, damages, and costs (including reasonable legal fees) arising from your content, your misuse of the service, or your breach of these Terms, to the extent permitted by law.
10. Termination
You may stop using Enot and delete your account (plugin Danger zone or email). We may suspend or terminate access for breach, abuse, legal risk, or non-payment. Provisions that by nature should survive (liability limits, indemnity, governing law) survive termination.
11. Governing law
These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law rules, except where mandatory consumer protections of your country of residence apply and cannot be waived. Courts in Germany shall have jurisdiction, subject to any non-waivable consumer venue rights.
12. Changes
We may update these Terms by posting a new version at /legal/terms and updating the date. Material changes may also be shown in the plugin. Continued use after the effective date constitutes acceptance where allowed by law.
